This privacy policy for GSYSTEM s.r.o., based at Karpatské námestie 10A, Bratislava 831 06, Slovakia, Business ID: 46 048 081 ('we', 'us', or 'our'), describes how and why we might collect, store, use, and/or share ('process') your information when you use our services:
What information do we collect?
When you use our services, we collect various types of data, such as your login email and password, your contacts, and other settings. We track the products you browse on our website and the device you use to access it. Additionally, we analyze your interests based on the offers we send you via email. From all this information, we derive further data about you to tailor personalized offers and improve our website in the future. When you contact us, make purchases, or create an account, we also process your first name, last name, your orders, and the information you set in your account settings.
Personal information you disclose to us
We process following personal information that you disclose to us:
- identification information, which might include your first name, last name, login email, password, Business ID, Tax ID (incl. VAT ID). These information are necessary for fulfilling our contractual obligations, managing your helpdesk account, and contacting you after successfully submitting our contact form.
- contact information, allow us to get in touch with you and might include your e-mail address, phone number, delivery address, billing address, and your social network account. Without these information, we would be unable to deliver our goods or provide our services to you.
- your preferences, which include your helpdesk account settings, such as language preference, time zone settings or e-mail notifications.
- your order information, which include information about the products or services you have ordered, delivery method, payment method (incl. bank account number) as well as any information about your complaints.
Personal information collected through third parties
We can process your personal information through joint marketing campaigns with third parties. We can also combine your personal information with information from third parties for the purpose of marketing campaigns as well fulfilling contractual obligations.
Personal information you disclose to us about third-parties
If you provide us with personal information about third parties, it is your obligation to inform the respective party and obtain their consent with our privacy policy.
Example: You will shop for a product but enter other person's name and contact information into delivery address. Therefore you will provide us with personal information about said person.
Information automatically collected
We can automatically collect following information when you visit, use, or navigate our website:
- information about your usage of our website, namely products or services you browse, links you click on, how you navigate or scroll through our website. We may also collect information about the device you use to access our website (e.g. operating system and its version, screen resolution, type of browser and version), IP address (incl. approximate location), date and time of accessing our website, and URL from which you access our website. If you access our website from a mobile device or tablet, we may also process information about such device (e.g. device make or build, error logs etc.)
- information about how you process our messages, namely date and time you open our messages or device you use to read our messages (incl. IP address and location, device information including but not limited to operating system and its version, screen resolution, type of browser and version).
- behaviour patterns, which we derive from your settings, items or services you purchase, your usage of our website or from how you process our messages. These information may include your age, gender, financial status or shopping behaviour.

If you create an account, we process your personal information for managing your account and providing associated services. If you buy our goods or services, we process your personal information to fulfill your order, protect our legal interests, and to comply with necessary laws and regulations. With your consent, we share your personal information with third parties for the purpose of displaying offers on other websites or offering you additional services.

What legal bases do we rely on to process your information?
The General Data Protection Regulation (GDPR) require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:
Performance of a Contract
We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our services, selling our goods, or at your request prior to entering into a contract with you. Once the contract is in force, we may process your personal information to ensure proper delivery of our goods or services. Such personal information may include your billing or shipping address.
Legitimate Interest
We may process your personal information to deliver you with personalized content. These information primarily include information automatically collected and cookies. Our legitimate interest is to provide you with an offer which is specifically tailored to your needs and preferences. We may further process your data by using analytical tools for the purpose of segmenting our users into audiences. Each audience will then receive a specific offer.
We may also send you e-mail and text messages. If you make a purchase from us as a representative of a legal entity, we process the same data as when fulfilling a contract and for the same purpose. Our legitimate interest is to conclude and fulfill the contract with the legal entity you represent.
We may use information about your settings and preferences for testing new functionalities or applications. Our legitimate interest is to enhance the quality of our service.
We process your personal information to protect our legal claims as well as keeping our internal evidence. Our legitimate interest is the protection of our legal rights and monitoring the quality of our services.
We also process your personal information for communication purposes. Our legitimate interest is to satisfy and record your requests (e.g. if you previously made a purchase and your request is related to said purchase).
You have a right to object to the processing of your personal information based on legitimate interest.
Consent
We may process your information if you have given us permission (i.e. consent) to use your personal information for a specific purpose (e.g. sales newsletter or telemarketing). You can withdraw your consent at any time.
When and with whom do we share your personal information?
We may share your personal information with third parties in the following situations:
- Delivery of goods: the shipping carrier would never be able to deliver you your order without us providing them with information about delivery location first. We will share the information based on your order confirmation. These information may contain your name, address, phone number, or amount to be paid for cash on delivery (COD) orders.
- Delivery of goods directly from our supplier (drop-shipping): if your order is being shipped directly from our supplier, we may be asked to share some of your personal information. These information may contain your name, address, phone number, or amount to be paid for cash on delivery (COD) orders. The supplier will then have to share these information with selected shipping carrier.
- Payment processing: in order to process your payment, we may share your personal information with our selected payment processor. These information may include your name, billing address, and total sum of your order. We do not receive your credit card information as they are securely transferred directly to our selected payment processor. The payment processor will then securely forward your information to respective financial institution (i.e. your bank).
- Warranty claims: in order to process your warranty claim, we may share your personal information with manufacturer or supplier.
- Marketing activities: we may share your personal information with advertising or social networks for the purpose of creating a personalized offer to you.
- Government entities: for the purpose of enforcing our claims, we may share your personal information with our legal representative. We will also share your personal information with government entities if we are obliged to do so.
- Sales newsletters: we may utilize third party tools to distribute our sales newsletters (e.g. by e-mail os text messages) or perform telemarketing services. Such party will be then contractually obliged to restrict the usage of your personal information for any other purpose.
How long do we keep your information?
We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.
If you have given us your permission (i.e. consent) to process your personal information, we will keep such information for the period of 7 or until you choose to revoke your consent.
In case of newsletter sign-up, we will keep your personal information for the period of 7 years or until you choose to unsubscribe from our newsletter.
We are legally obliged to keep your personal information that are necessary for performance of a contract. Such information will be kept even when you choose to revoke your consent for the period of 10 years or any other period with regards to respective law (e.g. 431/2002 Z.z., Coll. on Accounting. requires that all invoices need to be archived for the period of at least 10 years).
Personal information which we collect through your account settings or in a similar manner will be kept during the time you utilize our services and usually 5 years after termination. Following said period, we will usually keep only basic information about your reason for service termination or information which are stored on our backups.
How do we acquire your information?
We mostly acquire your information through your own input (e.g. placing an order, creating and using an account, through creating a support request, or contacting us using the appropriate web form). Furthermore, we collect your information by analyzing your behavior on our website or when reading our messages.
If you choose to place an order, we may collect additional information about you from banks, our payment processors or shipping carrier (e.g. we may acquire your bank account number from our payment processor, or a date / time of successful goods delivery from our shipping carrier).
What are your privacy rights?
You have a right to withdraw your consent from processing your information, right to request rectification, right to restrict the processing of personal information, right to object, right to complain, right to request access, right to data portability, and in some cases, right to request erasure.
Right to request access
You have a right to know which information we process, why we process them, how long we keep them, where we acquire them, with whom we share them, or what privacy rights you have in terms of our processing. You may find all these information in this "Privacy policy" document.
Right to request rectification
If you find out that the information we process are incorrect, you have a right to request rectification.
Right to data portability
You have a right to request a copy of personal information which you provided us with and those we process based upon your consent or performance of a contract. In order to comply with your request, we may provide you with information, which are automatically collected in our databases.
Right to request erasure
In some cases you may have right to request erasure of your personal information (the erasure will not be applied on information which we are legally obliged to archive e.g. invoices or delivery notes). If we require your personal information to enforce our claims or defend our rights, we may choose to decline your request (e.g. in case you have past due invoices). We will comply with your request if you meet one of the following criteria:
- The processing of your personal information does not serve its original purpose
- You revoked your consent for processing your personal information and there is no other legal basis for further processing
- You exercise your right to object against processing your information based on our legitimate interest and we conclude that there exists no legitimate interest for further processing
- You assume that our processing of your personal information is against current legal provisions
- A specific legal provision exists that require us to erase your personal information
- Information concerning minors (children below the age of 16 years)
Right to restrict the processing of personal information
In some cases, you may use your right to restrict the processing of personal information instead of right to erasure. This right allows you to temporarily (unlike right to erasure) request restriction from further processing of your personal information. We will comply with your request if you meet one of the following criteria:
- You claim that your personal information are inaccurate
- We process your personal information without any legal basis
- We do no longer need your personal information for further processing but you request them for enforcing your claims or defending your rights
- You object against processing of your personal information
Right to object

Right to complain
If you believe we are unlawfully processing your personal information, you also have the right to complain to respective Member State data protection authority. You can submit your complaint to Office for Personal Data Protection at the following e-mail address statny.dozor@pdp.gov.sk
Personal information regarding minors (children below the age of 16 years)
We do not knowingly solicit data from or market to minors. By using our website, you represent that you are at least 16 years old or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of our website.
